Supplementary Agreement to the Agreement on Cooperation
in the Fields of Science and technology between the Government of the
Republic of India and the Government of the Federative Republic of Brazil
for Scientific and Technological Cooperation on Railways
The Government of the Republic of India and The Government of the Federative
Republic of Brazil (hereinafter referred to as "Parties" ),
considering the reciprocal interest in increasing the cooperation on
the field of railways, in pursuance of the Agreement on Cooperation
in the fields of Science and Technology, signed in New Delhi, on July
22nd, 1985'
Mindful of the possibility of establishing a programme with a view
to cooperating, on mutually advantageous basis, in research and development
in the field of railway transportation, as well as aimed at promoting
the cooperation among experts from both Parties in the search for solutions
of common problems and improve the systems and techniques of transportation:
Have agreed as follows:
ARTICLE I
The Parties shall promote the cooperation between themselves in the
field of railway transportation concerning its scientific and technological
aspects.
ARTICLE II
The Parties agree that the coordinating institutions of this Supplementary
Agreement shall be on the Indian side, the Ministry of Railways, and
on the Brazilian side, the Ministry of Transportations. The executing
institutions of the cooperation activities established within the framework
of this Supplementary Agreement will be defined by the Parties, according
to the nature of the cooperation activities.
ARTICLE III
1. The cooperation between the Parties shall be carried out through
the exchange of information, documents and experts, as well as other
forms of cooperation to be agreed upon between the Parties in the areas
of railway transportation to be identified afterwards.
2. Each project of cooperation shall be the object of a project agreement
describing the information to be exchanged, as well as establishing
the details concerning the cost sharing and tasks involved in the project.
The project agreements shall be named Implementation Protocols of this
Supplementary Agreements.
ARTICLE IV
Each Party pledges itself not to transmit the information exchanged
under this Supplementary Agreement to third Parties without the previous
written consent of the other Party.
ARTICLE V
In order to implement this Supplementary Agreement, a Joint Work Group
shall be established. The Joint Work Group shall meet alternately in
India and in Brazil, with a view to defining the cooperation programmes,
reviewing and evaluating its activities. The date and place of the meetings
shall be established by the Parties, through diplomatic channels.
ARTICLE VI
Unless otherwise stipulated by the Parties, the Party that sends a
mission shall bear the international travel expenses. The receiving
Party shall bear the expenses related to domestic travel, board and
lodging.
ARTICLE VII
This Agreement will come into effect on the date of its signature and
shall remain in force for the period of four years and shall be automatically
renewed for the subsequent period unless either of Parties gives notice
to the other Party of its intention to terminate this Agreement at lest
three months before its expiry. Such a termination will, however, not
affect the ongoing projects which will be completed to their end, unless
the Parties decide otherwise.
Done at Brasilia, on this 15th day of September, 1993, in two originals
each in the Hindi, Portuguese and English translations, all the texts
being equally authentic. In case of any divergence of interpretation,
the English text shall prevail.
