MEMORANDUM OF UNDERSTANDING BETWEEN THE MINISTRY
OF SCIENCE AND TECHNOLOGY OF THE FEDERATIVE REPUBLIC OF BRAZIL AND
THE MINISTRY OF INFORMATION TECHNOLOGY OF THE REPUBLIC OF INDIA ON
THE COLLABORATION ON INFORMATION TECHNOLOGY SERVICES FOR SETTING UP
OF A BRAZIL-INDIA TASK FORCE ON INFORMATION TECHNOLOGY
The Minister of Science and Technology of the Federative
Republic of Brazil and the Minister of Information Technology of the
Republic of India;
HAVING met in Brasilia on the 8th of November,
2000 to examine ways and means to promote bilateral co-operation between
Brazil and India in the field of Information Technology (hereinafter
referred to as "IT");
REFERRING to the Framework Agreement between the
two countries in Science and Technology, signed in New Delhi on the
22nd of July 1985, in force since the 13th of
February, 1990;
CONSIDERING the very positive developments in the
relationship between India and Brazil, enhanced by a series of recent
high level visits, which confirm a mutual interest in the promotion
of stronger ties in science and technology;
CONSIDERING that both countries, being participants
in providing technology and services in the IT sector, intend to build
up their partnership in the IT sector in a variety of ways;
RECOGNISING the potential for extensive trade between
the two countries in the IT sector and the need to tap the capabilities
and opportunities in the sector in a more focused and comprehensive
manner;
RECOGNISING further the need to promote integral
links in the IT sector between the two countries with a view to leverage
capabilities and opportunities on both sides;
HAVING a mutual interest in the growth of investments,
joint ventures, joint initiatives, technology development and markets
in the IT sector; and
INTENDING to implement a technology and industry
co-operation programme aimed at fostering business partnerships between
both countries;
REACHED the following understanding:
1. To create a bilateral Task Force to explore mutual co-operation
in the following areas:

Research, Design and Development of ITs
-
Exploring Third Country Markets
-
Electronic Commerce
-
Electronic Government
-
Human Resource Development through Virtual Education
-
Information Security and Cyber Crime
-
Banking Automation
2. Composition and Responsibilities of the Collaboration

For the purpose of identifying and facilitating programmes, the
Ministries shall designate representatives as members of the bilateral
Task Force.

The Task Force shall propose to the Ministers the scope and mechanisms
of the co-operation. The Task Force may hold consultations to
identify and define future activities, review activities in progress
or discuss matters related to such activities. Where necessary,
and by mutual agreement, the Task Force may hold working meetings.

The composition of the Task Force and identification of key issues
and objectives would be established before each meeting of the
Task Force.
3. This Memorandum of Understanding shall be implemented
in accordance with the applicable laws and regulations of each country.
4. The conduct of co-operative activities as per
this Memorandum of Understanding shall be subject to availability
of funds and other resources. The cost of co-operative activities
shall be shared in a manner to be mutually agreed upon.
5 This Memorandum of Understanding may be amended
as may be required from time to time by mutual written consent of
the Ministers.
6. This Memorandum of Understanding shall come into
effect on the date of its signature and shall remain in force unless
terminated by either Ministry giving six (6) months` notice in writing
to the other Ministry.
